Merger Control
We provide strategic legal services for swift approval
in KFTC merger filing and review proceedings.
Overview
Merger control review is the procedure by which the Korea Fair Trade Commission examines whether a merger — such as an M&A or joint venture — substantially restricts competition. Mergers above a certain threshold are subject to mandatory prior notification, and completing a merger without filing may result in fines and corrective orders.
PYEONG AN supports the entire merger control review process, including drafting merger notification filings, relevant market definition analysis, competitive effects assessment, negotiations with KFTC case handlers, design of remedies (structural and behavioral conditions), and representation in administrative litigation if a merger is prohibited.
