Overview

Energy disputes are a specialized field in which energy-specific special acts — including the Electric Utility Act, the New and Renewable Energy Act, the District Heating Business Act, and the Urban Gas Business Act — interact in complex ways with contract principles under civil and commercial law. A deep understanding of the legal issues specific to the energy industry is required, including PPA breaches, EPC contract disputes, revocation of power generation business permits, and disputes over Renewable Energy Certificates (REC) transactions.

PYEONG AN assembles a team of litigation specialists in energy and construction and administrative litigation experts to comprehensively represent clients in civil, administrative, and arbitration disputes arising from energy projects. Working in close collaboration with our power plant project team, we formulate litigation strategies with a full understanding of the technical and commercial context of the project.

In particular, we provide pioneering advisory on new-type disputes arising from energy policy changes, such as compensation for coal power plant closures under the energy transition policy, relief for investor losses resulting from changes to renewable energy support schemes, and disputes related to changes in power market rules.
